Telehealth Consent

Learn what to expect from online evaluations, how your information is protected, and what you agree to when you use our telehealth services.

Last updated: October 21, 2026

1. Introduction

At My ESA Therapist, transparency and informed consent are important to us. This Telehealth Consent explains how online (telehealth) evaluations work, what you can expect, and the risks and limitations involved.

By scheduling, starting, or participating in an evaluation through our platform, you confirm that you have read, understood, and agreed to this Telehealth Consent. If you do not agree, please do not proceed with an evaluation.

2. Who We Are

Brand Name: My ESA Therapist
Role: Online platform that connects individuals with licensed mental health professionals for Emotional Support Animal (ESA) evaluations using secure telehealth technology.
My ESA Therapist does not provide medical treatment, therapy, or diagnoses, and does not guarantee ESA approval. All evaluation outcomes are based solely on the independent clinical judgment of the licensed mental health professional conducting your assessment.

3. What Is Telehealth?

Telehealth is the delivery of healthcare-related services using electronic communication technology instead of an in-person visit. For our services, this may include:
Secure video consultations
Phone or audio-only sessions
Secure messaging

Online questionnaires and intake forms

Electronic exchange of documents and records

4. Nature of Our Telehealth Services

Through our platform, you may be connected with a licensed mental health professional (LMHP) in your state who will:

Review the information you provide

Conduct an evaluation to understand your emotional or mental health needs
Determine, using independent professional judgment, whether an ESA letter is clinically appropriate
An online evaluation is not intended to replace ongoing therapy, psychiatric care, or emergency services. Telehealth may not be suitable for every individual or situation.

5. Your Consent to Telehealth

By proceeding, you acknowledge and agree that:
You are choosing to receive services through telehealth voluntarily
You understand how telehealth differs from in-person care
You have had the opportunity to ask questions before starting
You are 18 years of age or older
You are located in the state you selected at the time of your evaluation
All information you provide is accurate, complete, and truthful

6. Potential Benefits of Telehealth

Telehealth may offer benefits such as:
Access to licensed professionals from your home
Greater privacy and comfort during your evaluation
Reduced travel time and scheduling barriers
Faster access to qualified providers in your state

7. Potential Risks & Limitations

While telehealth is widely used, you understand there are potential risks, including:

  • Technology issues: Internet interruptions, poor audio or video quality, or equipment failure may delay or end a session.
  • Limited assessment: Your provider may not be able to observe or assess you as fully as in an in-person visit.
  • Privacy risks: Although we use secure systems, electronic communication always carries some risk of unauthorized access.
  • Incomplete evaluation: If your provider decides telehealth is not appropriate, they may end the session and recommend an alternative form of care.
  • Different outcomes: The result of your evaluation may differ from what you expected.

8. No Guarantee of ESA Approval

Completing an evaluation does not guarantee that you will receive an ESA letter. Your provider decides independently, based on their clinical assessment and the laws of your state. If you are not approved, applicable refund terms are described in our refund policy.

9. Provider Licensure & Your Location

  • Your evaluation will be conducted by a professional licensed in the state where you are physically located at the time of the session.
  • You agree to provide your accurate location, and to inform us if you move or travel to another state before your evaluation.
  • Services cannot be provided if you are outside the United States during your session.

10. Technology Requirements

To participate, you are responsible for having:

  • A stable internet connection
  • A working device with a camera and microphone (if video is required)
  • A private, quiet, and safe space for your session

We recommend not participating while driving, in public places, or on unsecured public Wi-Fi.

11. Privacy & Confidentiality

  • Your information is handled in accordance with our privacy policy and HIPAA Compliance practices.
  • Telehealth sessions are conducted over secure, encrypted technology.
  • Sessions are not recorded by My ESA Therapist unless you are informed and give consent in advance.
  • Confidentiality has legal limits. A provider may be required to disclose information to protect your safety or the safety of others, or when required by law.
  • You agree not to record, screenshot, or share any part of your session without written permission from all participants.

12. Not for Emergencies

My ESA Therapist is not an emergency service.

If you are experiencing a mental health crisis, thoughts of harming yourself or others, or any medical emergency:

  • Call 911 (or your local emergency number) immediately, or
  • Call or text 988 (Suicide & Crisis Lifeline) in the United States, or
  • Go to your nearest emergency room

Do not rely on our platform for urgent or crisis care.

13. Communication Consent

By using our services, you agree that we and your provider may contact you by:

  • Email
  • Phone calls
  • SMS or automated messages

These communications may relate to scheduling, evaluation updates, documents, or service support. Standard message and data rates may apply. You may opt out of non-essential messages at any time.

14. Fees & Payments

Fees for evaluations are displayed before you proceed. As noted on our website, we authorize your payment first and only charge it after your evaluation is completed. For more details, please review our refund policy.

15. Your Rights

You have the right to:

  • Ask questions about telehealth before and during your evaluation
  • Decline or stop a telehealth session at any time
  • Request an alternative, such as in-person care with a local provider
  • Request access to your information, subject to applicable laws
  • Withdraw your consent at any time by contacting us

Withdrawing consent may prevent you from continuing with our online services, and it does not affect services already completed.

16. Updates to This Telehealth Consent

We may update this Telehealth Consent periodically to reflect changes in our services, technology, or legal requirements. When changes occur, we may notify you by email or website notice. The updated version will always display a revised “Last updated” date.
